Compliance in Transnational Private Governance: The Case of the Marine Stewardship Council
Studies of compliance in the international relations literature have predominantly focused on state compliance with international treaties. Recent decades, however, have witnessed a great expansion of transnational private governance regimes where rules are set by nonstate actors (sometimes acting along with states) to seek compliance from companies operating in global supply chains. The design of these private regimes affords an opportunity to examine the drivers of compliance processes in global rule making systems. This talk will discuss the analysis of an original dataset of all fisheries certified with the Marine Stewardship Council (MSC) – a private governance regime for certifying responsible fisheries. The analysis focuses on how learning and institutional change affect the compliance process measured by the time it takes fisheries to pass the certification audit and the scores fisheries receive on their assessments.
